UPDATE: On April 21, 2020, The Alameda County Board of supervisors adopted a
County-wide eviction ban incorporating tenant activists’ extreme measures.

On Tuesday, June 9, 2020, they will consider amending the Eviction Moratorium plan
(see Agenda Item #28).

We are asking you email again to request they amend the Eviction Moratorium with provisions to help housing providers provide safe and affordable housing.

The provisions under consideration include:
1. Removing the provision that reclassifies overdue rent as a consumer debt and therefore enabling housing providers to use the normal unlawful detainer process.

2. Expanding allowable evictions to include causes related to public health and safety and if the property will be sold.

3. Requiring Tenants to provide formal documentation that they can’t pay rent due to the COVID-19 crisis and no documentation is currently required.
 
We are additionally requesting:
4. Requiring cities in the county to opt in or opt out of the ordinance in its entirety. Do not allow cities to cherry pick the ordinance for provisions to abide by and provisions to disregard, as this will create needless confusion.

5. Amend to enable shorter payback time frames. The current moratorium requiring 12 months is too long and forces housing providers out of business.

If you don’t make these changes it will be difficult or even impossible for me to continue owning and managing rental property.

I know the real estate markets are heating up and if you approve the ordinance without making these changes, it just makes a lot more sense for me to sell rather than try to comply with these new rules.
